Certified EU General Data Protection Regulation (GDPR)
From the 25th May 2018, the EU GDPR will impact every business in the UK that processes the personal data of EU residents. The Council of the European Union published a document regarding the processing of personal data which can be found on their website.
What is the GDPR?
GDPR stands for the General Data Protection Regulation. This regulation (Regulation (EU) 2016/679) by the European Council, Government and European Commission have implemented this document to strengthen and unify data protection for all organisations within the EU.
There have been a number of changes which have been introduced by this regulation which includes:
- What to do if your business is not in the EU
- The definitions of personal data and how it has broadened
- The procedures when processing data from Children
- The appointment of the data protection officer (which is mandatory for some companies)
- The updated requirements of data breach notifications
- The process of data that has the right to be forgotten
- The new restrictions on global transfers

- Being aware of the processes that are built on the principles of privacy by design
What about Brexit?
If your organisation is based in the UK, you will still need to comply with the GDPR, even when Brexit happens. This will come into force before Britain leave the European Union. The Government have also confirmed that the GDPR regulation will apply to UK businesses.
This European regulation orders harder penalties where businesses found in breach of the regulation can anticipate fines of up to 4% of the annual turnover or 20 million Euros (whichever is greater). It is incredibly important that originations are compliant with the GDPR to avoid these astronomical fines.
